Temporary Spousal Support

After the initial filing for divorce, the court may order that one spouse is in need of financial help while the divorce proceedings are ongoing. This temporary spousal support is determined by the court and is based on the needs and ability to pay.

Long Term or Permanent Spousal Support

Long Term Spousal Support or Permanent Support is based on more than just the need of one spouse and ability of the other spouse to pay. There are many factors (which often  can be highly contested).

These factors include:

• The length of time of  the marriage
• The standard of living established during the time of  marriage
• The needs of each party
• Each party's source(s) of income and earning potential
• Each spouses' ability to be self supporting
• The age and health of each spouse

During the process to establish long-term or permanent support, both parties will fully disclose all assets, debts, and expenses.  Importantly, there are penalties for hiding assets and often forensic accounts are used to fully investigate the financial situation.
